Revival of Company Strike off by The Registrar of Companies due to Non filing of Reply of Show Cause Notice issued by the Registrar u/s 248 (1)

You might be aware of the fact that the current status of your company is “Struck off” as the Company was in receipt of Show Cause notice issued by Registrar of Delhi & Haryana informing company’s directors about proposed action of suo-moto strike off company’s name from register of companies due to non-filings of Annual Return (MGT-7) and Financial Statements (AOC-4) with ROC/Ministry of Corporate Affairs.

There might be cases that the company is in operation or working and want to continue with its legal status but has skipped to make the reply of that notice or not made the same within 30 days of issuance of the same. And also the Company has not filed aforesaid filings within the prescribed time.

• even if company strike off by the registrar, directors turn out to be disqualifying for appointment and appropriate action against the director can be taken.
• if a director disqualifies then his office as director in all the companies simultaneously vacant
• if a director fails to comply with his duties then he is liable for penalty u/s 166(7) i.e. ‘fine which shall not be less than one lakh rupees but which may extend to five lakh rupees.
